Final Budget Notice and Notice of Special Meeting and Per Capita Tax Notice

NOTICE is given that the Proposed Final Budget for the General Fund of Northern Bedford County School District for the 2019-2020 fiscal year in its most recent form is available for public inspection at the school district offices, 152 NBC Drive, Loysburg, Pennsylvania, and will be presented for adoption as a Final Budget at a school board meeting to be held in the Room 136 of the Northern Bedford County High School, 152 NBC Drive, Loysburg, Pennsylvania at 6 p.m. on June 18, 2019. The budget may be amended before final adoption. This will be a regular monthly meeting of the School Board.

NOTICE is also hereby given that persons eighteen (18) years of age or over who become residents or inhabitants of this school district and persons attaining the age of eighteen (18) years while a resident or inhabitant of this school district are required by law within twelve (12) months thereafter to notify Northern Bedford County School District Business Manager, Loysburg, Pennsylvania (telephone (814) 766-2221, of their having become residents or inhabitants or their attainment of age. This notice is given in connection with the per capita tax levied by Northern Bedford County School District, and any person failing to comply with the requirements of this notice will be liable, in addition to the tax, for a penalty equal to the tax.

NOTICE IS HEREBY GIVEN that the following proposed Ordinance will be considered for adoption and voted upon at the regular meeting and public hearing of the Board of Supervisors of Taylor Township, Blair County, to be held on Monday, June 3, 2019, at 6:00 p.m. at the Taylor Township Municipal Building, 7217 Woodbury Pike, Roaring Spring, Pennsylvania 16673.

AN ORDINANCE OF TAYLOR TOWNSHIP, BLAIR COUNTY, PENNSYLVANIA, ESTABLISHING MAXIMUM SPEED LIMITS ALONG CERTAIN AREAS OF FREDERICK ROAD (TR-343)

Section 1 sets the speed limit for Frederick Road from the intersection with Cove Lane Road to the intersection with South Nicodemus Street at 35 miles per hour and the speed limit for Frederick Road from the intersection with South Nicodemus Street to the intersection with Cove Mountain Road at 25 miles per hour; Section 2 provides for penalties for violations; Section 3 provides that the provisions of the Ordinance are severable; Section 4 repeals prior inconsistent ordinances; Section 5 directs Township officials to post speed limit signs; Section 6 identifies the effective date of the Ordinance.

AN ORDINANCE OF WOODBURY TOWNSHIP, BLAIR COUNTY, PENNSYLVANIA, DECLARING CERTAIN ACTIONS AS PUBLIC NUISANCES; REGULATING JUNK; PROHIBITING DANGEROUS PROPERTIES, STRUCTURES AND BUILDINGS AS PUBLIC NUISANCES; REGULATING CERTAIN TYPES OF BURNING; PROVIDING FOR THE ABATEMENT OF OTHER ACTIVITIES AND PROPERTY CONDITIONS WHICH CONSTITUTE PUBLIC NUISANCES; AND PRESCRIBING PENALTIES FOR VIOLATIONS

Section I defines the term “Nuisance” and other terms used in the Ordinance; Section II provides that creating, permitting, or maintaining a nuisance shall be unlawful; Section III provides for the removal or abatement of nuisances; Section IV provides for penalties and procedures for violation and enforcement; Section V provides that the provisions of the Ordinance are severable; Section VI provides that liability for nuisances shall be the sole responsibility of the owner or occupant of the property; Section VII identifies the effective date of the Ordinance.

The Borough of Roaring Spring shall adopt the following Ordinance, at the Regular meeting to be held on June 10, 2019 at 6:00 p.m. at the Municipal Building 616 Spang Street, Roaring Spring, PA.

ORDINANCE NO. 2019-2 AN ORDINANCE OF THE BOROUGH OF ROARING SPRING, COUNTY OF BLAIR, AND COMMONWEALTH OF PENNSYLVANIA, PROVIDING FOR THE RECOVERY OF COSTS AND/OR PAYMENT FOR THE USE OF SPECIAL EQUIPMENT USED TO CONTROL AND/OR EXTINGUISH CHEMICAL, PETROLEUM, AND/OR HAZARDOUS MATERIAL SPILLS, FIRES, LEAKS, AND/OR ACCIDENTS INCURRED BY THE FRIENDSHIP FIRE COMPANY NO. 1 OF ROARING SPRING.

WHEREAS, by Ordinance Number 2019-2, Roaring Spring Borough, Pennsylvania, providing for the recovery of costs and/or payment for the use of special equipment used to control and/or extinguish chemical, petroleum, and/or hazardous material spills, fires, leaks and/or accidents incurred by the Borough; and

WHEREAS, the costs of clean-ups under this Ordinance are most often absorbed by the Friendship Fire Company No. 1, Inc., and

WHEREAS, Friendship Fire Company No. 1 is in the best position to recover clean-up costs and collect payments from responsible parties including but not limited to involved insurance companies; and

BE IT ENACTED OR ORDAINED by the Roaring Spring Borough, Pennsylvania, as follows:

Section 1.0: The owner of Chemical, Petroleum, and/or other Hazardous Materials, Substances or Waste, as defined in 13 Pa. C.S. §6020.101 et seq., or a common carrier of the same, shall be liable to the Borough of Roaring Spring for any costs incurred in controlling, extinguishing, containing, or removing (Clean up) of such substances following a spill, leak, accident, or discovery of such materials within the municipal boundaries of the Borough of Roaring Spring. Such costs shall include any expense or fee related to the use of special equipment, which is necessary to control, extinguish, contain, or remove any substances under this Ordinance. A common carrier shall include any pipeline carrying such materials. Such costs shall also be the responsibility of the owner of any common carrier.

Section 1.1: Special equipment shall include, but is not limited to the following:

a. Special chemical protective clothing;

b. Foam, dry, or chemical extinguishing agents and/or any other material used to

control and/or extinguish a fire involving such materials;

c. Any absorbent agent or material, and

d. Any other equipment and/or materials deemed necessary to clean up such

materials,

Section 1.2: At this time, such costs will only include the out-of-pocket clean up expenses incurred by the Borough of Roaring Spring. If in the future, however, any fire department subject to this ordinance ceases to be a volunteer fire department such that the Borough of Roaring Spring is obligated to pay wages for fire protection services, the clean up costs shall also include the

amount expended for such wages.

Section 2.0: The owner of any chemical, petroleum, and/or hazardous material, common carried, or owner of property where such materials are located and/or discovered shall also be liable for any cost associated with the temporary storage of such materials and/or the cost of disposing of the same.

Section 3.0: Any amounts due under this Ordinance may be recovered directly by the Friendship Fire Company No. 1, as the agent for the Borough, unless and until the Borough Council shall by formal Resolution revoke the agency of the Fire Company. The Fire Company shall have the authority to file, pursue and complete claims under this Ordinance. The Borough shall provide any assistance needed by the Fire Company in pursuit of any claims. All funds collected by the Fire Company shall be reimbursed to the party sustaining the loss.

Collectible costs shall be deemed to include reasonable attorney fees, and interest on any unpaid balance shall be due at a rate of six percent (6%) per annum. The Friendship Fire Company No. 1 shall provide the Borough with full updates of all claims pursued under this Ordinance and

how those claims were resolved.

Section 4.0: Any party obligated to satisfy a bill for charges under this ordinance the fails to pay any such bill within thirty (30) days, shall upon conviction in a summary proceeding before of a District Justice, shall be sentenced and/or fined as provided for by law.

Section 5.0: Imposition of any fine and/or sentence shall not relieve any responsible party hereunder from civil liability to the Borough of Roaring Spring nor shall it relieve such party if its obligation to satisfy the bill for any costs incurred under this Ordinance.

Section 6.0: This Ordinance is not intended to supersede any provisions of Pennsylvania's Hazardous Sites Cleanup Act, 35 Pa. C.S. § 6020.101 et seq. (Purdon's 1993), nor does it preclude

any action by the Department of Environmental Resources of the Commonwealth of Pennsylvania

or the Borough of Roaring Spring under the Act.

Section 7.0: This Ordinance shall be effective five (5) days after enactment.

Woodbury Community Yard Sale

The Woodbury Community Yard Sale will be held the weekend of June 7-June 8, 2019. Community clean-up week will be June 3-June 6, 2019.

The Borough encourages residents to keep their yards mowed and their property cleaned for this annual event as well as throughout the entire year in order to create a favorable impression on Woodbury Borough. We thank you for your efforts.
