AN ORDINANCE OF ROARING SPRING BOROUGH, BLAIR COUNTY, COMMONWEALTH OF PENNSYLVANIA, ELECTING TO AMEND ITS POLICE PENSION PLAN ADMINISTERED BY THE PENNSYLVANIA MUNICIPAL RETIREMENT SYSTEM PURSUANT TO ARTICLE IV OF THE PENNSYLVANIA MUNICIPAL RETIREMENT LAW; AGREEING TO BE BOUND BY ALL PROVISIONS OF THE PENNSYLVANIA MUNICIPAL RETIREMENT LAW AS AMENDED AND AS APPLICABLE TO MEMBER MUNICIPALITIES. IT IS HEREBY ORDAINED BY ROARING SPRING BOROUGH, BLAIR COUNTY, AS FOLLOWS:

SECTION I. Roaring Spring Borough (the Borough), having established a police pension plan administered by the Pennsylvania Municipal Retirement System (the System), hereby elects to amend its Police Pension Plan administered by the System in accordance with Article IV of the Pennsylvania Municipal Retirement Law, 53 P.S.  §881.101 et seq. (Retirement Law), and does hereby agree to be bound by all the requirements and provisions of the Retirement Law and the Municipal Pension Plan Funding Standard and Recovery Act, 53 P.S. §895.101 et seq., and to assume all obligations, financial and otherwise, placed upon member municipalities.

SECTION II. As part of this Ordinance, the Borough agrees that the System shall administer and provide the benefits set forth in the amended Police Pension Plan Document entered into between the Pennsylvania Municipal Retirement Board and the Borough effective as of the date specified in the adoption agreement (the Contract).

SECTION III The Borough acknowledges that by passage and adoption of this Ordinance, the Borough officially accepts the Contract and the financial obligations resulting from the administration of the Contract.

SECTION IV. Payment for any obligation established by the adoption of this Ordinance and the contract shall be made by the Borough in accordance with the Retirement Law and the Municipal Pension Plan Funding Standard and Recovery Act. The Borough hereby assumes all liability for any unfundedness created due to the benefit structure set forth in the Contract.

SECTION V. The Borough intends this Ordinance to be the complete authorization of the Contract, as amended and it shall become effective as of the date specified in the adoption agreement, which is the effective date of the Contract, as amended.

SECTION VI. A duly certified copy of this Ordinance and an executed Contract shall be filed with the System

FOR HOURLY RATE FOR CONTRACT LABOR & HOURLY EQUIPMENT RATE FOR EMERGENCY RESPONSE

The Roaring Spring Municipal Authority ("RSMA"), 616 Spang Street, Roaring Spring, PA 16673 is seeking bids to obtain hourly labor rates for independent contractors willing to provide labor services to RSMA on an as-needed basis during the remaining portion of 2019 and 2020.

All bidders must possess the following skill set and be ready to provide verification of that skill set if their bids are accepted:

• Bidder must have experience in sewage plant operations, including but not limited to an understanding of how the sewage treatment process works, sewage line distribution, repair and replacement and knowledge of water distribution, including but not limited to waterline repair and replacement.

• Bidder must have employees with confined space training.

• Bidder must have highway flaggers available at all times.

• Bidder must have the equipment at hand and the ability to respond to a water leak within one (1) hour,

• Bidder must provide a sealed bid setting forth the TOTAL hourly rate which will be charged for services rendered. Along with the hourly rate being stated in writing, the following documentation must be included:

• A list of equipment available for your use in the contract work being sought.

• Proof of workers' compensation coverage for all employees at limits required under applicable law.

• Proof of automobile insurance covering all vehicles which may be used in providing the contract labor under this bid, with liability and/or umbrella coverage in the aggregate of no less than $500,000.00 for an individual claim and $1,000,000.00 in total claims arising from one occurrence.

• Proof of liability insurance covering the bidder's negligence, with coverage (including applicable umbrella coverage) with limits of no less than $500,000.00 for an individual claim and $1,000,000.00 for an aggregate claim.

Bids and required documents must be delivered in a sealed envelope marked "Labor Contract Bid” no later than 3:00 p.m. on November 20, 2019 to RSMA's office at 616 Spang Street, Roaring Spring, PA 16673.

Bids will be opened at RSMA's meeting at 4:00 p.m. on November 20, 2019. RSMA reserves the right to reject all bids, and/or any bids which are not compliant with the Request for Bids. The lowest acceptable bids will be approved by RSMA's Board of Directors, to create a list of contractors who can be called for water and sewage labor needed during the remaining portion of 2019 and 2020.

The Ordinance is captioned:

AN ORDINANCE ESTABLISHING AN ON-LOT SEWAGE MANAGEMENT PROGRAM ORDINANCE GOVERNING MUNICIPAL MANAGEMENT OF ON-LOT SEWAGE DISPOSAL FACILITIES IN CATHARINE TOWNSHIP, BLAIR COUNTY, PENNSYLVANIA

Section 1 describes the name and purpose of the Ordinance; Section 2 defines terms used in the Ordinance; Section 3 provides that the Ordinance shall apply to all persons owning any property serviced by an on-lot sewage disposal system; Section 4 sets forth permit requirements for construction or alteration of an on-lot sewage disposal system; Section 5 provides for initial and routine inspections by an authorized agent of Catharine Township; Section 6 prohibits certain discharges into an on-lot sewage disposal system; Section 7 requires persons to perform certain regular maintenance of on-lot sewage disposal systems; Section 8 provides for the rehabilitation of malfunctioning systems; Section 9 provides for liens to be entered in accordance with law; Section 10 governs the disposal of septage; Section 11 provides for the administration of the Ordinance; Section 12 provides for appeals from decisions of the Township; Section 13 provides for penalties for violations of the Ordinance; Section 14 repeals prior inconsistent ordinances; and Section 15 provides for severability.

The Board of Supervisors of Greenfield Township, Blair County hereby notifies all interested parties that a SPECIAL BUDGET MEETING will be held on Tuesday, October 29, 2019, at 12:30 p.m. The purpose of the special meeting is to prepare the proposed 2020 budget and such other business as may become necessary may also be conducted. ORDINANCE NO. ____________

AN ORDINANCE OF THE BOROUGH OF ROARING SPRING, COUNTY OF BLAIR AND COMMONWEALTH OF PENNSYLVANIA WHICH REQUIRES OWNERS OF NON-RESIDENTIAL PROPERTIES TO OBTAIN AN OCCUPANCY PERMIT AND PROVIDE CERTAIN INFORMATION RELEVANT THERETO.

WHEREAS, the Borough of Roaring Spring has a valid interest in maintaining accurate information regarding non-residential real estate.

NOW, THEREFORE, be it ORDAINED and ENACTED as follows:

Section 1- Registration with Borough by Owner.

Every person, company or corporation who becomes the owner of non residential property in this Borough or proceeds to use the property for non-residential purposes shall report the following information to the Borough within thirty (30) days of any change of occupancy:

A. The names of persons, companies or corporations who are occupants of the property. In the case of a business involving the rental of storage spaces or units, the names of the individual renters of storage space need not be reported.

B. The date said person, company or corporation commenced to use the property for non-residential purposes

C. Complete present and former address of said occupants.

D. A general description of the non-residential activity being conducted at the property.

Section II- Registration of Tenants.

Any property owner who leases, rents or permits any person, company or corporation to occupy any part of the property owner's property for non-residential purposes, shall report the following information to the Borough within thirty (30) days of any tenancy being started:

A. The names of persons, companies or corporations who are occupants of the property. In the case of a business involving the rental of storage spaces or units, the names of the individual renters of storage space need not be reported.

B. The date said person, company or corporation commenced to use the property for non-residential purposes.

C. Complete present and former address of said occupants,

D. A general description of the non-residential activity being conducted at the property.

Section III- Occupancy Permit Forms and Fees.

A. Any property owner subject to the reporting provisions of Sections I and II above shall complete the needed occupancy permit forms as developed by the Borough from time to time.

B. The Borough may charge a processing fee for each occupancy permit filed with the Borough, said fee to be established by the Roaring Spring Borough Council from time to time.

Section IV- Intention of Ordinance.

The purpose of this Ordinance is to allow the Borough to maintain adequate information concerning non-residential uses in the Borough and to assure compliance with other applicable ordinances.

This Ordinance is not a substitute for any other occupancy required pursuant to any other applicable Federal, State or Borough law ordinance,

This Ordinance shall be deemed not to impose any reporting requirement on any residential rental property or portion of a property used for residential rentals. The Ordinance shall further not be deemed to require the reporting of the names of the individual renters of storage space.

Section V- Penalties

Any person, company or corporation who shall violate any provision of this part shall, upon conviction thereof, be sentenced to pay a fine of not more than Three Hundred Dollars ($300.00) and costs. Failure to report each non-residential space in a property which is separately designated or used for non-residential purposes shall be constituted as a separate violation under this Ordinance.

NOTICE OF PUBLIC HEARING TO BE HELD BY THE

ROARING SPRING BOROUGH COUNCIL TO TAKE

COMMENT CONCERNING AMENDMENTS TO SECTIONS 202, 501.C1and 503.C3 OF THE ROARING SPRING

BOROUGH ZONING ORDINANCE

NOTICE IS HEREBY GIVEN that on Tuesday, November 12, 2019 at 5:30 p.m., at the Roaring Spring Borough Building, 616 Spang Street, Roaring Spring, PA 16673, the Borough Council of Roaring Spring, Blair County, PA will hold a public hearing to receive public comment concerning the proposed passage of amendments to Sections 202, 501.C1and 503.C3 of the Roaring Spring Borough Zoning Ordinance (the “Ordinance Amendments”).

The Ordinance Amendments are as follows:

SECTION 202. Definition of Terms shall be amended to include the following definitions:

BREWERY – A facility that brews ales, beers, meads, and/or similar beverages onsite.

BREWERY PUB — A facility where malt or brewed beverages are manufactured onsite. The brewery may sell, transport and deliver malt beverages to various offsite locations; however, the majority of the manufactured malt or brewed beverage products are sold and consumed on-premises.

CLUB/LODGE – A business establishment operated for social, recreational, educational or fraternal purposes, some serving alcoholic beverages where permitted, but open only to members and their guests.

RESTAURANT/SIT DOWN, LOW TURNOVER — A restaurant where customers are served at a table or counter by a restaurant employee and given an individual menu. Included in this group are restaurants that serve cocktails or have cocktail lounges.

SIDEWALK CAFÉ - An extension of the services of an existing establishment, including, but not limited to, serving food and beverages for consumption within an existing building, to the extent that food and beverages are permitted to be served and consumed at tables placed on the public sidewalk adjacent to and within the confines of the frontage of that portion of the building in which the establishment is situated. A sidewalk cafe contains readily removable tables and chairs, is enclosed by rope and stanchion unless some other barrier system is approved by the Borough as an architectural design element, and shall be otherwise open to the air.

TAVERN, BAR, PUB - a building or part thereof primarily engaged in the retail sale and the on-site consumption of alcoholic beverages by consenting adults. This definition includes, but is not limited to, beer gardens, cocktail lounges, saloons and taprooms. Restaurants that serve alcoholic beverages but are primary engaged in the retail sale of prepared food are not included in this definition.

SECTION 501. C1(A) – Central Business Commercial District – Permitted Uses shall be amended to the following:

18. Eating establishments which do not include the sale or use of alcoholic beverages.

SECTION 503. C3 – Highway Commercial shall be amended to add the following:

H. Conditional Use:

1. Brewery

2. Brewery Pub

3. Club/Lodge

4. Restaurant/Sit Down Low Turnover

5. Sidewalk Café

6. Tavern, Bar or Pub

In addition to the standards and criteria set forth in Section 1010. Conditional Uses, the following shall be applicable:

1. All such establishments must be fully licensed by the Pennsylvania Liquor Control Board and must meet all applicable rules, statutes and regulations imposed by law.

2. The hours of operation and activities must be appropriately scheduled to protect the existing neighborhood from detrimental noise, disturbance or interruption.

3. The owner and operator of the establishment shall be responsible for the conduct and safety of the patrons.

4. No more than one (1) identification sign shall be permitted and the sign shall be a ground or a wall sign. The graphic area of the sign shall not exceed forty (40) square feet.
