ORDINANCE NO. 2020 - 623
AN ORDINANCE OF THE BOROUGH OF MARTINSBURG TAKING OVER HENRY’S POND LANE LOCATED IN THE BOROUGH OF MARTINSBURG, BLAIR COUNTY, PENNSYLVANIA
WHEREAS, by virtue of the Borough Code 8 Pa. C.S.A. §1731 and §1732 and after notice duly given and hearing held in accordance with the law, in the judgment of the Council of the Borough of Martinsburg, Blair County, Pennsylvania, it has been determined that it is necessary for the public convenience for said Borough to take over as a Borough road the section or portions of road and/or roads as hereinafter described;
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Council of the Borough of Martinsburg, Blair County, Pennsylvania, and it is hereby ORDAINED AND ENACTED by authority of the same:
Section 1. Pursuant to the judgment of said Council, the following described road known as Henry’s Pond Lane (and formerly known as Spring Drive and/or or Locust Street, an extension to Market) is hereby taken over and accepted by the Borough of Martinsburg as part of the road system of the Borough of Martinsburg, to wit:
All that certain parcel of land situate in the Borough of Martinsburg, Blair County,
Pennsylvania, bounded and described as follows;
Beginning at an existing railroad spike set in pavement on the east side of Locust Street; thence S 23°46'19" W a distance of 40.25’ to the start of the right-of-way to be dedicated as described by the following metes and bounds; thence S 23°46'19" W a distance of 12.66' to a point; thence S 65°58'44" E a distance of 169.57' to a point on the western right-of-way line of Market Street; thence along said right-of-way, S 23°40'37" W a distance of 50.00' to a point; thence N 65°58'44" W a distance of 209.65' to a point; thence N 23°46'19" E a distance of 62.49' to a point; thence S 66°13'41" E a distance of 40.00' to a point, which is the point and place of beginning. Having an area of 10983.72 square feet and consisting of 0.252 acres.
Section 2. The Borough Solicitor is authorized and directed to file a certified copy of this Ordinance together with a draft, survey and plan of roads taken over showing the location and width thereof, in the Office of the Clerk of Courts, Blair County, Pennsylvania.
Section 3. The effective date of this Ordinance shall be five (5) days after the ordaining and enactment thereof.
